Механізм захисту прав і свобод людини: європейський досвід

Abstract

Досліджено особливості механізму захисту прав і свобод людини. Окреслено причини важливості для Європейського Союзу питання щодо захисту прав і свобод людини. Встановлено, що з моменту прийняття Конвенції про захист прав людини та основоположних свобод Радою Європи на території ЄС розпочався процес формування нової європейської системи захисту прав і свобод людини. Наголошено, що обсяг прав, які захищає Конвенція, це відносно обмежений каталог прав людини, який можна порівняти за змістом з багатьма іншими міжнародно-правовими документами, а його ефективність полягає не в переліку гарантованих прав, а в складному інституційному механізмі контролю за їх дотриманням. Органом, який забезпечує цей контроль, є Європейський суд з прав людини. Конвенція забезпечує конкретні права для кожної особи, а її положення ЄСПЛ розглядає як норми прямого застосування. Визначено, що європейський механізм захисту прав і свобод людини є комплексним та інтегрованим підходом що передбачає взаємодію міжнародних та національних інститутів для забезпечення дотримання прав кожного громадянина. Peculiarities of the mechanism of protection of human rights and freedoms have been studied. The reasons for the importance of the issue of protection of human rights and freedoms for the European Union are outlined. It has been established that since the adoption of the Convention on the Protection of Human Rights and Fundamental Freedoms by the Council of Europe, the process of forming a new European system for the protection of human rights and freedoms has begun on the territory of the EU. It is emphasized that the scope of rights protected by the Convention is a relatively limited catalog of human rights, which can be compared in terms of content with many other international legal documents, and its effectiveness lies not in the list of guaranteed rights, but in a complex institutional mechanism for monitoring their observance. The body that ensures this control is the European Court of Human Rights. The Convention provides specific rights for each person, and its provisions are considered by the ECtHR as norms of direct application. It was determined that the European mechanism for the protection of human rights and freedoms is a complex and integrated approach that involves the interaction of international and national institutions to ensure the observance of the rights of every citizen
